ARTWORK TOS

Usage Agreement

All Commissions are for Personal Use only. Commissioned Work may not be used for AI purpose, NFTs, or merchandise. All commercial use of the artists artwork must be discussed. The client MAY do the following without permission: Personal Merchandise (redistributed to friends and family) such as stickers, keychains, posters, etc merch. This merchandise can NOT be sold for monetary profit.

Design Resale (customs)

Customs may not be sold exceeding their original commission value. Free Designs obtained through raffles or other means have no monetary value and should only be traded or gifted. Commissioned Artwork that has been added to a design will increase the value and allows for the pricing to be adjusted.

Payment Plans

Clients who wish to set up a payment plan must agree to automatic monthly payments via a card payment of their choice. Your card information will not be asked for. Card payments will be made through a secure provider (Stripe).The buyer is fully financially responsible for making payments in a timely manner. Refunds will not be given should the client's balance be charged via an automatic payment, unless the client wishes to fully cancel the purchase. Full refunds are provided for Adoptables.For Customs or other art, 13% of the commission is non-refundable if a sketch has already been delivered. If nothing has been delivered from the artist to the client, then a full refund is applicable and can be requested at any time.

Delivery Process

When commissioning the artist, the client understands art style will alter, vary, or change. They understand artwork is a practice, and the artist is using commissions to improve their skill and apply studies to expand their knowledge in art.
The client is encouraged to reupload wherever they like as long as the artist is credited for their work.The average Commission wait time is two to three months.Discord is widely used for communication between the artist and the client. Most of the time, they should expect links from Gyazo (a screenshotting tool). Do NOT open any other links or interact with anything that seems suspicious.

Refund Policy

The commissioner may request a refund if outlines have not been delivered.13% of the total commission cost is non-refundable once the work has begun. A full refund is applicable if no work has been sent to the client.No refund is available beyond the outline phase or final stages of the commission.

Client Revisions

Depending on the commission, one or many progress updates will be sent to the commissioner. It is encouraged throughout the commission to request changes if desired.The client is responsible for clearly communicating any changes or revisions during the early stages of the commission to avoid dissatisfaction later.Significant changes requested after final approval may incur additional costs or be declined.

Complexity Fee

Characters with overwhelming amounts of patterns of details may incur an additional complexity fee.Complexity fees are assessed during the initial consultation based on the client's description and references.All complexity fees will be discussed and approved by the client before work begins.

Artists' Rights

I (the artist) maintain the right to decline, refuse, or refund a commission at any time for any reason.

Creative Limitations

There is a small list of things I refuse to draw. Refusing to draw these things does not mean I encourage hate or disrespect towards other peoples' beliefs and interests.These Include:

DESIGN TOS

Up-Front Payment

If ABing an adoptable, purchaser is required to pay a portion of the AB claim payment up-front, usually $200. If the final price of the adoptable is less than $200, the entire amount will be expected upon purchase.I do not do holds, up-front payment is a requirement.

Finalized Design

The final design will not be altered, what you see is what you get. The design may be altered through commissions however you'd like. You may even draw over the purchased art itself, once the adoptable falls into the buyer's hands, it is theirs.

Resale Value

Do not purchase an adoptable to resell it for a profit. The only way you can increase its value is by commissioning other artists and tacking that commission value on it. Do not doodle something, slap it on, and try to resell it for +$100 or something. I will tell all the other artists and then blacklist you.

Design Licensing & Commercial Use

Small creators (artists, indie devs, VTubers, streamers, etc.) may use my designs for merch and personal projects without needing a commercial license.However, the artwork I created for the design may not be used for merchandise unless it is for personal use only.You are welcome to use my artwork for advertising or promotional purposes, WITH artist credit.Large companies or commercial entities must contact me to discuss licensing before using my art or designs.

Blacklist

Due to known repeated TOS violations, these users may not own, acquire, or purchase any of my designs.
